Pipeline Easement Dispute Results in Settlement Twenty Times Original Offer

Our firm recently assisted a family who had a conflict with the gas industry over the location of a pipeline. In this particular case, the family was approached by a landman who was representing the gas company's interests. The landman reached an agreement with the family that the easement would run through a certain portion of the family's property. The family was satisfied with this location and with the compensation received for the easement at that particular location. The family trusted the landman and readily signed the Deed granting the pipeline easement to the gas company.

Unfortunately, the Deed was silent as to the location of the easement and the gas company informed the family that it was installing a pipeline in the very location where it assured the family that it would not install the pipeline. The family refused to give in to the gas company's demands and the gas company sued the family. Prior to court, our firm was able to negotiate the payment of a large cash settlement to the family in exchange for the pipeline being located where the gas company desired.
